2. GENERAL TERMS AND CONDITIONS OF SALE

The purchase of products offered on the web site www.luxyuu.com are regulated by the following general conditions of sale, and the user is invited to read them carefully. 2.1 The products offered by Project-5 S.r.l. on www.luxyuu.com for its business of electronic trade address only to final-users that are consumers (by consumer we mean any person acting on www.luxyuu.com with own purposes and not referable to commercial enterprises or professional activities).

2.2 Project-5 S.r.l. offers on www.luxyuu.com products and develops activities of electronic trade exclusively to subjects that are 18 years old (majors), having the legal capacity to access and conclude binding contracts with a valid e-mail address.

2.3 Project-5 S.r.l. reserves not to take orders from subjects who do not have the requirements of points 2.1 and 2.2.

3. CONTRACT EXECUTION

In order to enter into the contract for the purchase of one or more products on www.luxyuu.com, the customer must fill out the order form in electronic format and send it electronically to Project-5 S.r.l. following the instructions.

In the form there will be a reference to the general terms and conditions of sale, a summary with the information about the products, the price (including national taxes, not international import or export taxes) of each product, methods of payment and delivery, shipping charges (additional to the prices of the products), and references to the terms and conditions for the refund policy of purchased products.

3.1 the contract shall be concluded between Project-5 S.r.l. and the final customer when the first receives via telematics the order form fully and correctly filled out by the customer; the latter must have the requirements expressed in the general terms of conditions of sale, which are essential in order to enter into the contract.

3.2 by sending the order form fully filled out, the customer accepts unconditionally and undertakes to observe the general terms and conditions of sale in relations with Project-5 S.r.l. The sending of the order form presupposes a full knowledge of these general conditions and acceptance of the same, both in the whole and in the individual articles of it and any further information in the web sites here linked.

The customer is requested not to send the order form in case of non-acceptance.
- before sending the form the customer will be asked to read carefully the general terms and conditions of sale, and to print a copy for his personal use. The customer will also be required to identify and correct any mistakes of data that could keep Project-5 S.r.l. from accepting the order.
If the form order is not correctly filled out by the user, Project-5 S.r.l. will not be responsible for possible delays.
The order form will be filed at the data bank of Project-5S.r.l. for the time necessary to execute the order, and in any case for the period provided for by the law.

3.3 With the conclusion of the contract, Project-5 S.r.l.vundertakes to provide the purchased product;
- Project-5 S.r.l. reserves in any case not to accept the orders that come from subjects not included in the categories listed in the commercial area, those orders that do not give sufficient guarantees of solvency, that are incomplete or those that are not correct; if the products are not available, the order will not be accepted as well.
In all of these cases, Project-5 S.r.l. will communicate by e-mail that the contract shall be interpreted as not concluded and that the order will not be executed, specifying the reasons; in case of unavailability of the products after having received the order form, Project-5 S.r.l. will promptly inform the customer; if the sum has already been paid, Project-5 S.r.l. will refund the customer. 3.4 When the contract is executed,Project-5 S.r.l. will inform the customer the order has arrived via telematics, giving a summary of the essential data and starting the delivery of the goods:
description of the product, price, shipping charges, general terms and conditions of sale, returns policy, method of payment.

3.5 The official language of conclusion of the contract is Italian; if necessary, English can be used; may any discrepancy between the two languages appear, the Italian text prevails on the other. 4. GUARANTEES AND PRICES OF OUR PRODUCTS

Project-5 S.r.l. offers on www.luxyuu.com top-quality and luxury products, which are purchased from manufacturers and retailers that are carefully selected for the strong quality-controls on the goods. Project-5 S.r.l. does not sell used and flawed products or goods of a lower quality than the one corresponding to the market standards.

Only the vintage products in the specific section may be used or worn previously. www.luxyuu.com will have the responsibility to specify in detail the conditions of each individual product if it does not conform to the market standards:

the basic characteristics of the product are specified in the individual product-cards of the web pages of www.luxyuu.com; Project-5 S. r.l. has no responsibility if a particular configuration of your computer or a malfunction causes an alteration of the colors and/or of the characteristics of the displayed products or, in any case, if they are not identical to the real ones.
The prices are displayed together with the respective product, and they may be subjected to updates. In any case, the customer must check the final price before sending the relevant order form.
The prices of the products reflect the prices of goods, including I. V. A. (Italian tax - equivalent to VAT); they do not include shipping charges.

5. PAYMENTS

7. SHIPPING AND DELIVERY OF THE PRODUCTS

In order to get to know the specific shipping and delivery methods, the customer may access to the shipping section within the Customer Area. The customer must pay maximum attention to the information reported in this section, because these indications form the integral and substantial part of the general terms and conditions of sale; therefore they are considered to be fully accepted from the moment the order form request is sent to Project-5 S.r.l.

7.1 Deliveries are made through couriers set out in the shipping and delivery section of the Customer Area; we do not deliver to P.O. Boxes and, in the Italian territory we do not deliver to Campione d'Italia, Livigno, and in the state of San Marino and the Vatican.

7.2 The deliveries of the purchased products are insured against theft, loss, and accidental damage, without additional costs for the customer. When the products reach the destination indicated by the customer in the order form, the purchased products are not insured anymore. Therefore, at the time of delivery, the customer must carefully check the contents of the package even before signing the receipt of the item. The products are delivered in an appropriate packaging sealed with adhesive tape

7.3 If there are alterations in the packaging or pilfering of goods, the customer can refuse the delivery, or sign with reserve stating the reasons, otherwise the delivery will be considered as accepted.

7.4 In case of acceptance with reserve, the customer has 4 (four) days from the receipt of the goods for complaints, by sending a written communication to the courier that has made the delivery, to the address shown in shipping; and in any case the customer must contact directly Project-5 S.r.l. by e-mail at myluxyuu@luxyuu.com, in order to receive instructions on the management of the damage.
Project-5 S.r.l. has no responsibility if the customer does not follow the exposed directives.

7.5 If the parcel will not be delivered to the indicated address, for reasons not attributable to the courier, the same can be returned to the sender with fees chargeable on the customer, including all the costs of reimportation of goods on the Italian territory.
Such fees will be deducted from any possible reimbursement in favour of the customer.

7.6 the import duties and local taxes relating to the sale, for the deliveries in Italy and in all the European Union, are included in the price published on the website www.luxyuu.com.

 

8. REFUND AND RETURNS POLICY

If the customer is not satisfied with the order, he will be able to withdraw from the contract with the seller Project-5 S.r.l., not later than 10 (ten) days from the receipt of the goods and give them back to the courier within 14 (fourteen) days, running from the receipt.

8.1 In order to withdraw from the contract it is necessary to use the return form which can be downloaded from the section returns in the customer area of www.luxyuu.com.; it must be correctly filled out and sent electronically. This form is delivered by Project-5 S.r.l. together with the ordered goods.

8.2 the right of withdrawal may be exercised by the customer also respecting the following terms:

• the customer must communicate its will to return the product within 10 (ten) days from the receipt of the purchased goods;
• the product should be returned to the courier within 14 (fourteen) days from the receipt of the products;
• the product must not been worn, used or washed.
• it is not deprived in no way of his mark, label, tag, pendant, disposable seal, and whatever other servant to identify the item;
• the product must be returned bent, if its nature so provides, together in the original package or a packaging that guarantees the integrity of the shipped good.
• If the customer returns more products in a single order, these must be sent to Project-5 S.r.l. in a single shipment; Project-5 S.r.l. reserves the right not to accept products of the same order which are returned and sent in different moments.

8.3 By using the right of withdrawal properly, according to the terms and ways already described, Project-5 S.r.l. will refund the whole price of the product, with an additional shipping charge, This cost is depending on the nature of the shipping, weight and distance from the italian Luxyuu.com wearehouse.The customer has the right to use another courier for the refund. Project-5 s.r.l. and Luxyuu.com will not be responsible for the shipping charges or for any loss or damage on the products.

8.4 If the terms and conditions are not respected, the customer will not be entitled to the reimbursement of paid sums; but it may request Project-5 S.r.l. to get back the product in the same state in which it has been returned at its own costs. Otherwise Project-5 S.r.l. may withhold the product and the money paid by the customer for the purchase of the same.

 

9. REFUNDS

Once the customer has received the return form, checking if terms and conditions have been respected, Project-5 S.r.l. will send an e-mail confirming to the customer the refund has been accepted. In this case the reimbursement will be done as fast as possible, no matter how the customer had paid.; however, the maximum time is 30 (thirty) days, starting from the day the seller learnt the customer wanted to exercize his right of withdrawal, after the seller has checked it and the returned products have been accepted.

9.1 If the recipient of the products indicated in the order form is different from the one who made the payment for such products, the amount paid for returned items will be refunded by project-5 S.r.l. to the person who made the payment.

9.2 project-5 S.r.l. indicates UPS as official package delivery company for returning products. With UPS, the customer will pay the shipment costs for the return at the same price he had received it. Thus the seller may pay the shipping charges and track each package.

9.3 If the customer decides to return products using a different shipping company other than the one indicated by project-5 S.r.l., we will not be responsible for the shipping costs or for any loss or damage on the products

 

10. PROPERTY

All the other distinguishing marks which distinguish the products sold on www.luxyuu.com and in the website are trademarks of the respective owners and are used within www.luxyuu.com with the only purpose of distinguishing, advertising and describing the products for sale. All the holders of registered trade marks have the right to make exclusive use of marks of their ownership. No one is authorized to use those trademarks, to distinguish products or services, whether related to those of www.luxyuu.com or of the other owners of trademarks or not.
